People can access this link to volunteer to <br />help support our military families. <br />AMEND Acting Mayor Montour opened the Public Hearing to consider the <br />CUP — Amendment of a Conditional Use Permit for outdoor storage to include up <br />200 RYAN to three storage containers at 200 Ryan Drive as requested by Russ <br />DRIVE — Fischer. The Planner and the Planning Commission recommended <br />RUSS approval of the request subject to conditions. <br />FISCHER <br />The City Planner reported that Russ Fischer is requesting an amendment <br />to his existing Conditional Use Permit to allow the placement of up to <br />three storage containers in the designated outdoor storage area at 200 <br />Ryan Drive. These storage containers will be used to store materials that <br />are currently being stored inside the building. The containers are 8 feet by <br />8.5 feet by 20 feet in length. The Planner indicated that Mr. Fischer has <br />indicated that he will paint the storage containers to match his building. It <br />was noted that the Fire Marshal has reviewed the request and finds it to be <br />in compliance with the Fire Code. The City Planner recommended <br />approval of the CUP amendment subject to compliance with the <br />recommendations in his report dated March 2, 2012, the City Code, and <br />the Fire Code. <br />McGraw suggested that any approval include an August 1, 2012 date for <br />completion of the painting of the storage containers. <br />Mark Schultz, 2610 Park Street, asked why a CUP was necessary. The <br />Planner reported that the use of outdoor storage containers are regulated <br />under the Conditional Use Permit process. Schultz felt that the use of <br />CUPs and Variances degraded the City's Zoning Code. Schultz indicated <br />that it took a long time to develop the City's Zoning Code and stated that <br />every time the Council steps outside the Code, it is more difficult to say no <br />to the next person that makes a CUP or Variance request. Schultz felt it <br />was not appropriate to use storage containers to hide trash that has <br />accumulated on a property. He did not feel this was really cleaning up a <br />property. <br />Keis noted that the use of storage containers is an approved conditional <br />use under the Zoning Code. A CUP is required so that conditions can be <br />placed on the use of the containers relative to placement, number, etc. <br />Montour noted that the City has dealt with the issue of outdoor storage in <br />Ryan Industrial Park for many years in order to improve the appearance of <br />the park while considering the business needs of the property owners. <br />2 <br />
