City of Little Canada, Minnesota <br />Ordinance <br />AN ORDINANCE AMENDING CHAPTERS 1003.010 AND 1006.020 OF THE <br />LITTLE CANADA CITY CODE, KNOWN AS THE SUBDIVISION ORDINANCE, BY <br />PROVIDING FOR RESTRICTIONS ON THE SUBDIVISION OF NEW LOTS LOCATED <br />NEAR PETROLEUM PIPELINES. <br />The City Council of the City of Little Canada hereby ordains: <br />Section 1, <br />Section 1006.020 is hereby amended to add the following: <br />1 Pi•eline Setback. Where the •ro.osed subdivision is <br />subject to an easement for a pipeline transporting hazardous <br />fluids, includin• but not limited to natural •as, liquid <br />•etroleum oil diesel fuel •asoline, or other similar product, <br />or the proposed subdivision is located adjacent to such an <br />easement, no lot may be designed that includes any buildable area <br />within fifty (50) feet from the edge of any such easement. Any <br />lot subject to such an easement shall contain a buildable area of <br />no less than sixty (60) feet of width and sixty (60 feet of depth <br />outside the setback established by this section. <br />Section 2. <br />Section 1003.010 is hereby amended to add the following: <br />PIPELINE. A pipe with a nominal diameter of six (6) inches <br />or more that is used to transport hazardous fluids. For the <br />purposes of this definition, pipelines do not include sanitary <br />sewer lines installed and maintained by the City or other <br />governmental agency, or an approved private property owner. <br />Section 3. <br />This Ordinance shall take effect and be in full force from and <br />after its passage and publication. <br />William Blesener, Mayor <br />ATTEST: <br />Joel Hanson, Administrator <br />AYES: <br />NAYS: <br />
