MINUTES <br />PLANNING COMMISSION <br />JANUARY 13, 2004 <br />SUBDIVISION <br />ORDINANCE - <br />PIPELINE <br />SETBACKS <br />The City Planner reported that the proposal meets the criteria of the <br />Zoning Code amendment just acted upon. <br />Duray recommended approval of a Conditional Use Permit allowing <br />motor vehicle and recreation equipment sales (indoor) and garages <br />accessory thereto for 3173 -3177 Spruce Street as requested by Rick Igo <br />subject to compliance with the recommendations of the City Planner. <br />Motion seconded by Weihe. <br />Motion carried 6 — 0. <br />The City Planner reviewed a proposed amendment to the Subdivision <br />Ordinance which establishes pipeline setback requirements for new <br />subdivisions. The Planner noted that the City currently has a Pipeline <br />Setback Policy, but indicated that enacting an ordinance will provide the <br />City greater enforcement ability. The Planner also noted that this <br />provision is proposed as part of the Subdivision Code relative to new plats <br />rather than the Zoning Code so as to not create non- conformities for <br />existing development. <br />Knudsen noted that the proposed amendment establishes the setback from <br />the edge of the pipeline easement rather than the pipeline itself Knudsen <br />asked if this was because in some situations it is difficult to know the <br />exact location of the pipeline. The Planner indicated that that is correct. <br />Knudsen asked about the construction of public streets with relation to <br />pipeline easements. The City Planner noted that the City Code requires <br />that streets and street rights -of -way be outside pipeline easements. <br />In reviewing the proposed amendment, the Planner suggested that the last <br />sentence of the first section be amended to read: "Any lot subject to such <br />an easement shall contain a buildable area of no less than sixty (60) feet of <br />width and sixty (60) feet of depth outside the setback established by this <br />section." <br />Duray asked the impact on the pipeline setback policy if this ordinance is <br />adopted. The Planner indicated that the policy would still be in effect and <br />would be used as a guideline when dealing with development that would <br />not require platting. <br />Wojcik recommended approval of an ordinance amending Chapters <br />1003.010 and 1006.020 of the Little Canada City Code, known as the <br />Subdivision Ordinance, by providing for restrictions on the subdivision of <br />new lots located near petroleum pipelines as amended by the City Planner. <br />
