March 4, 2005
VIA FACSIMILE & E -MAIL
Mr. Joel R. Hanson
City Administrator
515 Little Canada Road
Little Canada, MN 55117
Re: Interim Ordinance Establishing a Moratorium (CUP in I -P District)
Our File No. 10771
Dear Joel:
Please find enclosed an Interim Ordinance Establishing a Moratorium relative to the
consideration and issuance of conditional use permits for open and outside storage as an
accessory use within the "I -P" Industrial Park District. As you will notice, the enclosed Interim
Ordinance does not specify an expiration date in Paragraph (C). Minn. Stat. §462.355, subd. 4,
provides that an interim ordinance may be enacted for a period not to exceed one year.
However, the extension of that initial period now requires a public hearing and written findings.
Therefore, the Council has the authority to establish a moratorium for 12 months, or a shorter
period, by specifying the date of expiration in the enclosed Ordinance.
If anyone has any questions relative to this matter, please contact me.
Very truly yours,
SWEENEY, BORER & SWEENEY
Thomas M.
