MINUTES <br />CITY COUNCIL <br />FEBRUARY 13, 2008 <br />T-MOBILE The City Administrator reviewed his report dated February 8, 2008 <br />WATER TOWER relative to T-Mobile's request to enter into a lease agreement with the <br />LEASE City for the placement of nine antennas on the City's water tower. He <br />AGREEMENT noted that the City currently has a similar lease in place with AT & T, and <br />the conditions of the T-Mobile lease are similar. The Administrator <br />pointed out that the monthly rent amounts are the same including the level <br />of rent escalation. Insurance limits are somewhat higher in the T-Mobile <br />lease given changes to the City's insurance limits. The cancellation clause <br />is also somewhat different. The Administrator pointed out a revised <br />provision he presented to the Council this evening which requires T-Mobile <br />to provide a $2,000 escrow deposit so that the City can hire a independent <br />inspection company to inspect the antenna installation to ensure that it has <br />not degraded the tower in any way. He noted that it is likely that the City <br />would hire AEC, a company that specialized in these types of inspections. <br />The Administrator reported that the City Attorney has reviewed the lease <br />agreement and found it to be in order. <br />The Mayor asked if the lease with AT & T prohibits the City from entering <br />into any other lease agreements of a similar nature. The City Administrator <br />reported that it does not. Both leases do address the issue of potential <br />interference from various carriers on the tower. The lease requires the <br />carrier causing interference to correct the problem. <br />Steve Carlson, T-Mobile, noted that with today's technology and given the <br />placement of the two carriers on the tower, it is unlikely that there will be <br />any interference issues. <br />The Mayor asked about the future painting of the water tower and the <br />impact to the antennas. Carlson indicated that this issue is addressed in the <br />lease. When the City decides to paint the tower, it would notify the <br />antenna carriers, and they would take the steps necessary to protect their <br />equipment. <br />The Mayor noted that the equipment building is considerably smaller than <br />the AT & T building. Carlson replied that that was correct. It was also <br />noted that the T-Mobile antennas will be painted to match the color of the <br />water tower. <br />The City Administrator reported that another carrier has also expressed <br />interested in the water tower, and a third lease agreement may be presented <br />to the Council in the near future. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOL UTION NO.2008-2-36 -APPROVING THE LEASE <br />AGREEMENT WITH T-MOBILE FOR ANTENNA PLACEMENT ON <br />3 <br />
