Hamel Estates <br />Development Contract <br />Hamel Estates Plat. In recognition of benefits received, Developer shall execute a Waiver of <br />Right to Appeal Special Assessments for each buildable lot within Hamel Estates (Lots 1 through <br />7) in the base amount of $5,493.64 per lot ($38,455.48 total for all lots). Developer also <br />acknowledges the option of the City providing Little Canada water to the Twin Lake area. In the <br />event this occurs, the waived amount shall increase by up to $857.15 per lot ($6000.05) based on <br />the additional per lot assessment levied upon properties benefited by this improvement. Each <br />waiver shall be in the same form as indicated in Exhibit C. Said waivers are to be binding upon <br />the Developer, its successors, representatives, and assigns. <br />25. Developer shall eliminate existing access to Owasso Boulevard located in the <br />vicinity of Lot 1, Block 2. All access to the lots contained within Hamel Estates shall be via <br />Hamel Court. <br />Easements <br />26. Developer shall acquire and dedicate easements as necessary for the construction <br />and maintenance of the Required Improvements pursuant to City requirements, including, but not <br />limited to utility easements for sanitary sewer and water systems and any other easements the <br />City deems appropriate, including those associated with the Twin Lake Road Improvement. <br />Developer shall pay all costs relating to the acquisition of the necessary easements, including <br />attorney's fees, costs, appraisals, the cost of the necessary property, and any other special <br />conditions which Developer shall negotiate with any affected property owner(s). Developer also <br />agrees to reimburse City for any costs associated with the acquisition of the easements including <br />drafting, review and recording. <br />27. Developer shall obtain consents to any required easements as necessary. <br />28. Developer hereby grants City, its agents and employees, a license to enter any of <br />Developer's property to perform all necessary work, maintenance and /or inspections deemed <br />
