amount of fill needed he may have to receive Council approval for this permit. He indicated he
was unaware of the permit needed and would be in to make application.
Also pending, is the application they made in 2002 for outdoor storage and architectural review.
This matter was tabled due to the Edgerton Street Bridge project. With the plans now known for
the area, it is believed Buetow Brothers should be able to complete their plans Bob talked to
Joel about this matter. During that conversation Bob indicated to Joel that they are have been
approached and are reviewing the idea of selling the property. Bob asked for further time to
evaluate the sales option. They should be getting back to us now. Joel also discussed the fill
with Bob and confirmed a permit would be needed for this type of work.
Jim Cossack — 421 Eli Road
The City Attomey's office asked us to hold up on issuance of further citations pending a review
of the facts. A meeting with the City Attorney, the City Administrator, the Building Official, and
myself took place this past week. We will be issuing new citations for violations of the zoning
code, building code, water system ordinance, sewer ordinance and electrical code in the next few
days. We will then continue with citations on a weekly basis thereafter. The delay in issuing the
citations is preparation of a new report with appropriate documentation that can be used by the
prosecutor.
Valor Enterprises — 3165 Spruce Street
Valor Enterprises is requesting to amend their original CUP to allow for more outdoor storage
and to relocate the sales lot. This matter came before the Planning Commission back in October
2003. Fred Sedaghat, Property Owner, has requested to table this matter to allow him time to
revise his site plan and review grading options. Fred in the application was asking for the
outdoor storage of 150 cars. This new site plan should show a more detailed layout of the lot,
plus more realistic expectations for the number of cars. The number of cars is also pending due
to the drainage concerns he has with the rear portion of his lot. The City Engineer went to the
site and determined that the drainage problem was a result of their own lot (files indicated
drainage has been a concern on this lot dating back to 1983. The engineer's recommendation
was that Valor grade their lot to direct runoff from the middle of the lot to the outer edges and
ditches created to hold and convey the water to the very back of the lot. Fred disagreed with this
report and has requested to hire his own engineer to review the site.
Attached is the letter I sent to Valor Enterprises on December 16, 2003. At that time, the 60 -day
waiver was about to lapse and no additional information had been submitted by Valor
Enterprises. Fred came into city offices on December 19, 2003 and met with Joel at that time
revised deadlines were set. (Revised deadlines were agreed to due to his apparent confusion with
his past agreements.) January 19, 2004 is the deadline for his site plan to be submitted and April
9, 2004 is the deadline for grading designs.
Benchmark Auto — 3176 Spruce Street
The two main areas of concern with Benchmark Auto are the outdoor storage and auto license. I
put together a report (see attached) back in August 2003 detailing these items. Since that time,
Steve Carlson has been into visit with Joel and myself about his business operations. Steve has
indicated to us that he needs to have some outdoor storage to run his business. He has submitted
ft: \Jessica]ACode Enforcement AConespondenceACode Ent' 2004VI -7 Cow —_'3 'ate.doc
