MINUTES CITY COUNCIL JULY 28, 2004 CONDITIONAL USE PERMIT — 315 SAVAGE LANE — ADELMANN City's ordinance as is. The City's ordinance currently allows gun sales as an accessory, use. Montour noted that at the last meeting the Indication vas that Mr. Kennedy's lease was contingent upon necessary approvals from the City. If those approvals are not forthcoming, the impression was that Mr. Kennedy would be able to get out of his lease. Anderson felt that for a city the size of Little Canada it was appropriate to not allow gun sales as a principal use. Anderson also Felt that if the Code were amended to allow this use, the City would be faced with the difficulty of enforcing any conditions it would place on gun stores. Anderson pointed out that the City does allow gun sales as an accessory use, therefore, it is not impossible for a business to locate in Little Canada and sell guns as long as gun sales are accessory to the principal use. Montour agreed with Anderson's comments, and felt that the City's code should remain as is. LaValle stated that he would support a Zoning Code amendment allowing gun stores as a principal use. He reported that he discussed the issue with the Mayor who indicated that he would not oppose a zoning change subject to compliance with the recommendations of the Sheriffs Department. However, it was noted that it would take four votes of the Council to amend the Zoning Code. LaValle opened the public hearing to consider a request for a Conditional Use Permit to allow a second garage at 315 Savage Lane in addition to the existing attached garage. The Planning Commission recommended approval of the CUP. The Council indicated that they had some questions for the applicant and since he was not present, action would be tabled. Given that the City's 60- day review period will expire prior to the next Council meeting, the City Administrator recommended tabling subject to the execution of a 60 -day waiver by Mr. Kurt Adehnann, the applicant. He further recommended that in the event he would not sign the waiver, the Council should deem the request for CUP denied.
