Mn /DOT Agreement No. 81650 AMENDMENT NO. 1 TO Mn /DOT AGREEMENT NO. 81650 Contract Start Date: June 13, 2001 CFMS No. A -26226 Total Contract Amount: $64,470.00 Ori ginal Contract: $64,470.00 Previous Amendment(s) Total: $ 0.00 Current Amendment: $ 0.00 State Project (SP): 6285 -123 Trunk Highway (TH): I -694 Project Identification: Rice Street Land Use Transportation Stud This amendment is by and between the State of Minnesota, through its Commissioner of Transportation ( "State ") and the City of Shoreview (hereinafter "Governmental Unit "); Ramsey County, Minnesota; City of Vadnais Heights, Minnesota; and City of Little Canada, Minnesota (hereinafter "Local Units of Government "). Recitals I. The State has a contract with the Governmental Unit and the Local Units of Government identified as Mn /DOT Agreement Number 81650 ( "Original Agreement ") to conduct a land use /transportation study on I -694 at the Rice Street Interchange. 2. The State instructed the subcontractor completing the land use study to halt work until the State was able to determine its design needs. The State has determined its design needs and would like the subcontractor to finish up the remaining work under this contract. The Metropolitan Council is terminating their involvement under this contract. The funds will be shifted to make up for the Metropolitan Councils lack of participation. 3. Exhibit C -1 is attached and incorporated into this Contract. 4. The State and the Governmental Unit and the Local Units of Government are willing to amend the Original Agreement as stated below. Agreement Amendment In this Amendment deleted contract terms will be siruek -eut and the added contract terms will be underlined. REVISION 1. Article 1 "Term of Agreement" is amended as follows: 1.1 Effective date: The date the State obtains all required signatures undcr June 13, 2001 pursuant to Minnesota Statutes § 16C.05, subdivision 2. 1.2 Expiration date: July 31, 2003 March I, 2005 or until all obligations have been satisfactorily fulfilled, whichever occurs first. REVISION 2. Article 3 "Payment" is amended as follows: 3.1 Consideration. This is a cost participation project between all parties. The total estimated cost of this project is $64,470.00. Costs will be divided as listed below. (1) Compensation. State's total participation for this project will be one lump sum payment of $9,670.50 equaling 15% of the total project cost. Governmental Unit's total participation for this project will be one lump sum payment of $4-4T-505775 $30.623.25 equaling 22.5% 47.5% of the total project cost. (rev 07/03) CSS
