Honorable Mayor and City Council <br />June 4, 2004 <br />Page Two <br />2. The City could choose to award the contract to the low bidder. Per the specification, <br />General Conditions section 4,2 "In case of conflict between the drawings and <br />specifications, the specifications shall govern." Therefore the low bidder would be <br />required to supply the structure at the bid price received on the bid. However it is <br />assumed that the low bidder would not honor their bid based on the fact that it did <br />not include supplying the structure and the significant cost it would incur. In that <br />case the City would have the option to declare the bidder in default, in which case <br />the bid bond of the low bidder would become the property of the City as outlined in <br />the Information To Bidders (attached). It is assumed that these actions would be <br />challenged by the low bidder. <br />The storm shelter structure is the largest component of the project and has a significant impact <br />on the bids. As a result, it is our recommendation that the City of Little Canada reject all bidders <br />at this time and rebid the project with the clarification that the Contractor shall supply the storm <br />shelter structure. We have discussed our recommendation with the City legal staff and they are <br />in agreement with the recommendation. <br />It is our intention to rebid the project as soon as possible and the new advertisement period <br />would be from Tuesday, June 8, 2004 thru Wednesday, June 30, 2004 when the new bids <br />would be publicly opened.
