MINUTES CITY COUNCIL JULY 24, 2002 PRELIMINARY & FINAL PLAT - TACHENY ADDITION ARCHITEC- TURAL REVIEW — POOLSIDE ADDITION Jon Weiss, Common Bond, reported that they are in the process of finalizing HUD financing for the Garden Terrace Addition. It is their hope that construction will begin approximately September 1 ". Fahey opened the Public Hearing to consider the Preliminary and Final Plat for the Tacheny Addition consisting of eight towno(Fce units. It was noted that the Planning Commission has recommended approval of the plat. There was no one present from the general public wishing to comment on this matter. Upon motion by LaValle, seconded by Scalze, the public hearing was closed. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO. 2002 -7 -174 — APPROVING THE PRELIMINARY AND FINAL_ PL A T FOR THE 7ACHENY ADDITION SUBJECT TO COMPLIANCE WITH 7'HE RECOMMENDATIONS OF THE CITY PLANNER AND THE CITY ENGINEER, INCLUDING DEDICATION OF AN APPROPRIATE SIDEWALK EASEMENT ALONG RICE STREET The foregoing resolution was duly seconded by Scalze. Ayes (5) LaValle, Scalze, Anderson, Montour, Fahey. Nays (0). Resolution declared adopted. Fahey opened the Public Hearing to consider the Architectural Review relative to the Poolside addition at 121 East County Road C. The Planning Commission recommended approval of the architectural review subject to compliance with the recommendations of the City Planner and City Engineer. The Council reviewed the recommendation of the Public Works Director relative to an electrical line that was placed within the City's storm sewer pipe. It is his recommendation that this line be relocated as a condition of approval. There was some discussion regarding who is responsible for relocation of the electrical line. Fahey indicated that the City did not need to be a party to that discussion. The issue was between the property owner and Xcel Energy. 7
