Bud ka
Sweeney, Borer & Sweeney
Professional Association
Attorneys at Law
Suite 1200
386 North Wabasha Street
St. Paul, Minnesota 55102
August 22, 2002
VIA FACSIMILE and US MAIL
Mr. Joel R. Hanson
City Administrator
515 Little Canada Road
Little Canada, MN 55117
Re: Conditional Use Permit Application (Allegiance Equipment Sales, LLC)
2925 Country Drive, Suite 103
Little Canada, MN 55117
Our File No. 9981
Dear Joel:
Telephone
(651) 222-2541
Facsimile
(651) 223-5289
At your request, we have reviewed certain material relative to the above captioned
platter, including a Dealer Application for a Minnesota Motor Vehicle Dealer License.
Paragraph 7 of the front side of the application relates to a display area for at least five vehicles.
Paragraph 11 relates to the location meeting all local zoning requirements.
The second side of the Application requires a description of the status of the zoning of the
property in question. The subject use is a conditional use within a Planned Unit Development.
To preclude any possible misunderstanding by the State of Minnesota relative to the Application,
I assume that the Conditional Use Permit, if issued by the City, would have specific conditions
relating to restrictions of the proposed use as an "office only" use, with no indoor or outdoor
display of vehicles allowed.
Therefore, I would recommend that these restrictions be indicated on the second side of
the Application, with a specific reference to the Conditional Use Permit, described by a number
or a date. I would also recommend that the Conditional Use Permit be attached to the
Application and that the Application contain the additional language that the Conditional Use
Permit is "attached hereto and made a part hereof by reference ". After including the specific
language on the Application, it would be appropriate for the Zoning Administrator to sign the
Application where indicated on the second side of the Application.
