MINUTES <br />CITY COUNCIL <br />JANUARY 30, 2008 <br />Mr. Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2008-I-2I -APPROVING THE FINAL PLAT <br />FOR WHISPERING PINES SUBJECT TO COMPLL4NCE WITH <br />THE RECOMMENDATIONS OF THE CITY PLANNER, CITY <br />ENGINEER, AND THE PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />Blesener thanked the property owner and developer for their cooperation <br />in lengthening the cul-de-sac which resulted in the lots being larger and <br />wider. <br />QUEBEC The City Administrator reported that as part of the planning for the <br />APARTMENTS- Unweave the Weave project, the City and MN DOT had extensive <br />NOISE WALL discussions on components of the project, including noise walls. The <br />Administrator noted that as part of the City's approval of the project, it <br />requested that the noise walls in front of Quebec Apartments and the <br />redevelopment area along Country Drive be deleted. The Administrator <br />noted that the City's concern was with aesthetics in having a short section <br />of wall (in front of the Quebec Apartments) along Country Drive. At the <br />time the City made this request, MN DOT said it was unlikely that the <br />wall in front of Quebec would be deleted given environmental justice <br />issues. The Administrator also indicated that Ted Zinner, Quebec <br />Partnership, asked if the wall would be built in front of Quebec. The <br />Adminishator stated that he informed Mr. Zinner that it was very likely <br />the wall would be built given the environmental justice issues cited by MN <br />DOT. The City Administrator then followed up with MN DOT and <br />discovered the wall had been deleted. The Adminisriator reported that <br />MN DOT did not inform the City on the status of this section of noise <br />wall. <br />The Administrator reported that Mr. Zinner is requesting that the noise <br />wall be constructed in front of Quebec Apartments. In discussions with <br />MN DOT, it is there position that if the City wants the noise wall added <br />back into the project, it will have to pay for it. The City Administrator <br />noted the City has a few discussion points to address with MN DOT as to <br />why they are financially responsible for the noise wall. <br />Blesener asked about the environmental justice issue. The City <br />Administrator stated his recollection was there were standards that had to <br />be met in determining need for a noise wall relative to residential <br />properties abutting a freeway project.
