and provisions of and has been found to be consistent with the official City <br />Comprehensive Land Use Plan. <br />2. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed site is or will be compatible with present and future land uses of <br />the area. <br />3. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use conforms with all performance standards contained herein. <br />4. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use will not tend to or actually depreciate the aggregate property <br />values in the area in which the amendment or conditional use is proposed. <br />5. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use can be accommodated with existing public services and will <br />not overburden the City's service capacity. <br />6. The applicant shall demonstrate by clear and convincing evidence that the <br />development of the conditional use shall reflect the architectural character <br />of the conforming buildings in the surrounding area in regard to the <br />following: <br />a. Proportion, scale and roof line; <br />b. Architectural style; and <br />c. Exterior finish materials. <br />Private garages are a permitted accessory use in the R -1 District. The subject site is <br />guided for low density residential land uses by the Comprehensive Plan. Provided <br />certain conditions are upheld, the proposed garage will be compatible with existing and <br />future land uses in the area. The proposed garage must comply with the required <br />performance standards as discussed below. <br />Structure Height. According to the Ordinance, detached accessory structures may not <br />exceed 15 feet in height (measured to the mid -point of the roof). As shown on the <br />submitted building elevation, the proposed garage is to include a second floor loft <br />space. The usable area of the loft space is intended to be maximized via the inclusion <br />of shed dormers. If the height of the building is determined from the midpoint of the <br />shed dormers, the garage measures 20 feet in height. If measured to the midpoint of <br />the gable, the garage measures 16.5 feet in height. <br />As a condition of CUP approval, the building should be modified to meet the maximum <br />15 foot height requirement of the Ordinance. This could be accomplished by replacing <br />the shed dormer with smaller individual gabled dormers, so the roof is not dominated by <br />the dormer feature.
