MINUTES <br />CITY COUNCIL <br />FEBRUARY 25, 2026 <br />Christina Kolb, resident, commented that she is an office manager at an apartment complex and spoke <br />of how the metro surge operation has impacted some of her residents. She asked that the city make, <br />even a symbolic statement, to let neighbors know that they are here for them. <br />PUBLIC HEARINGS <br />CONSIDER A CONDITIONAL USE PERMIT FOR AN ACCESSORY BUILDING AT 2912 <br />VANDERBIE STREET <br />The Community Development Director presented a request for a Conditional Use Permit (CUP) to <br />construct a detached accessory building in the rear yard of the property located at 2912 Vanderbie <br />Street. The proposed accessory structure would have a footprint of approximately 1,512 square feet <br />and a height of approximately 20 feet, 4 inches. The structure is intended for year-round indoor <br />recreational use by the household. Under the City's zoning regulations, detached accessory buildings <br />that exceed maximum area or height limitations, or that utilize post -frame construction or non- <br />traditional exterior materials, require a CUP. The applicant's proposal exceeds the maximum by -right <br />size allowance by a small margin, exceeds the maximum height allowance, and proposes post -frame <br />construction. <br />Mayor Fischer opened the public hearing for comments from the general public. <br />Nick Schwalbach, applicant, stated that this project began as a sport court and turned into the proposed <br />project. He stated that they considered attaching this to the home, but believed that this design would <br />be less impactful to their neighbors. He commented that the height and enclosed structure would allow <br />his family to enjoy their sports year-round. He stated that, with the exception of three mature trees on <br />the property, his family has planted all the landscaping on the property and would continue to invest in <br />that plan. <br />Mayor Fischer asked and received confirmation that the structure would be heated. <br />Kwapick asked if there would be plumbing in the building. Mr. Schwalbach replied that they do not <br />have plans to include plumbing, although there would most likely be an outdoor spicket for the <br />sprinkler system. <br />Malone asked if the applicant had been in one of these buildings and asked about the noise. Mr. <br />Schwalbach replied that the inside of the building can get loud, but there is minimal noise transferred <br />to the outdoors because of the insulation that will be added. He stated that having it open in the <br />summer would have more noise transferred, but still less than if there were an outdoor sports court. <br />A resident commented that they believe this is a good project. <br />There were no further comments from the public. Upon motion by Miller, seconded by Gutierrez, the <br />public hearing was closed. Ayes (5). Nays (0). Motion adopted. <br />Miller stated that the Planning Commission had a good discussion and agreed that a fence would not <br />be a benefit. He asked if the use of the building could be changed to a garage or ADU in the future. <br />2 <br />
