MINUTES <br />CITY COUNCIL <br />FEBRUARY 25, 2026 <br />The Community Development Director commented that the CUP includes details about the function. <br />He stated that an added condition could be placed upon the CUP related to use if there was concern, <br />although he recognized that it may be difficult to enforce. He confirmed that a request for an ADU <br />would need to come back to the City for approval. <br />Miller agreed that this type of structure would generate less noise than a sport court. <br />Kwapick commented that he asked about plumbing, as that would be needed for an ADU and would be <br />a larger expense to add in the future. <br />Mayor Fischer stated that he would like to have some level of screening required, such as plantings and <br />bushes. <br />The Community Development Director provided language that could be added to the fourth condition. <br />Mr. Schwalbach provided additional comments on his thoughts, and Mayor Fischer found that to be <br />reasonable. <br />Kwapick introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2026-2-22 — APPROVING A CONDITIONAL USE PERMIT FOR A <br />DETA CHED A CCESSOR Y B UILDING A T 2912 VANDERBIE STREET WITH THE <br />ADDITIONAL CONDITION THAT A LANDSCAPING PLAN MUST BE SUBMITTED <br />TO CITY STAFF <br />The foregoing resolution was duly seconded by Miller. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />ORDINANCE 930, AMENDING ZONING CODE CHAPTER 910 SHORELAND DISTRICT <br />The Community Development Director explained that this ordinance represents the final component of <br />the City's broader accessory structures and buildings code update, addressing regulations that apply <br />specifically within the Shoreland Overlay District. The primary objective of this amendment is to <br />allow water -oriented accessory structures (WOGS) on residential shoreland lots under clearly defined <br />and enforceable standards. The Minnesota Department of Natural Resources (DNR) staff identified <br />several existing deficiencies in Chapter 910 that extend beyond the proposed WOAS change. He <br />reviewed the proposed changes. <br />Gutierrez referenced the identification of tributaries and asked about the impact that would have on a <br />property. The Community Development Director replied that it would have a non -consequential <br />impact on that property. He explained how they will model to determine the portion of the lot that <br />would be impacted, noting that they will continue to work with the DNR. <br />Mayor Fischer recognized that change would impact the Ryan Industrial Park and a number of City - <br />owned properties that would be developed in the future. He asked if approving this language would <br />reduce leverage in how this would impact the city. <br />3 <br />
