He stated that the DNR is willing to work with them on this, noting exceptions that could be <br />available in the City Code and review process. <br />Miller asked for examples of WOAS. The Community Development Director provided examples of <br />WOGS, which are typically small sheds. He acknowledged that there are some already in existence. <br />Mayor Fischer opened the public hearing for comments from the general public. <br />Aaron Doeden, 2680 Edgerton Street, noted the reference in the measurement using the ordinance high <br />water (OHW) mark for WOAS and asked if the measurement could be done in another way. He <br />explained that not all properties have the same type of shoreline, as some shoreline has more of a drop <br />off. He stated that he would like to have the ability to have a shed on the lakeside property, without it <br />being too close to the road. <br />There were no further comments from the public. Upon motion by Miller, seconded by Gutierrez, the <br />public hearing was closed. Ayes (5). Nays (0). Motion adopted. <br />Miller asked if there would be an option for a variance in that situation. The Community Development <br />Director confirmed that there would be a variance process for that type of request. He stated that he <br />did ask the DNR if the measurement could include the drop off and was told that it is not an option. <br />Kwapick introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2026-2-23 — ADOPTING ORDINANCE 930, AMENDING CHAPTER <br />910 OF THE CITY OF LITTLE CANADA ZONING CODE TO PERMIT KATER- <br />ORIENTED A CCESSOR Y SIR UCT URES IN THE SHORELAND O VERLA Y DISTRICT <br />AND MAKE OTHER MINOR AMENDMENTS REQUIRED BY THE MINNESOTA <br />DEPARTMENT OF NATURAL RESOURCES AND APPROVE A SUMMARY <br />ORDINANCE FOR PUBLICATION <br />The foregoing resolution was duly seconded by Miller. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />RESOLUTION AMENDING AND RESTATING THE ENABLING RESOLUTION <br />ESTABLISHING THE LITTLE CANADA ECONOMIC DEVELOPMENT AUTHORITY FOR <br />THE CITY OF LITTLE CANADA <br />The Community Development Director provided background information, noting that the City of Little <br />Canada established an Economic Development Authority (EDA) by enabling resolution in 1989. At <br />that time, the city elected to have the City Council serve as the governing body of the EDA. While the <br />City's 1989 enabling resolution established the EDA, it did not clearly and expressly grant Housing <br />and Redevelopment Authority (HRA) powers as authorized under Minnesota Statutes Sections 469.090 <br />to 469.1081. Granting HRA powers to the EDA expands the Authority's statutory purview and <br />provides clearer authority to undertake housing and redevelopment activities, including the use and <br />administration of Local Affordable Housing Aid (LAHA) funds. Formalizing these powers ensures <br />that the EDA operates within an unambiguous statutory framework and reduces legal uncertainty when <br />implementing housing -related programs. <br />.19 <br />
