involving personal gain to her, then City shall have no obligation to pay the aggregate salary, <br />accrued and unused vacation or sick leave provided in this paragraph. <br />If prior to July 2, 2004, City reduces the salary or other financial benefits to Rueckert <br />in a greater percentage than across- the -board reduction for all City employees, or if City <br />refuses, following written notice, to comply with any other provisions of this Agreement <br />benefiting Rueckert, then Ruecicert may, at her option, be deemed to be "terminated" on the <br />date of such reduction or refusal to comply with the provisions of this Agreement. In this <br />event, Rueckert shall be entitled to severance pay in accordance with this Agreement. <br />If Rueckert voluntarily resigns her position with the City, Rueckert agrees to give City twenty - <br />eight (28) days advance notice. If Ruecicert voluntarily resigns her position with City, there <br />shall be no severance pay due to Rueckert nor payment for unused sick leave. Rueckert will <br />be paid for unused vacation pay. <br />12. GENERAL EXPENSES. City recognizes that certain expenses of a non - personal and job <br />affiliated nature will be incurred by Rueckert. City agrees to reimburse or to pay said <br />expenses, subject to approval of the City Administrator. <br />13. HOURS OF WORK. The position of Accounting Supervisor will require an average of over <br />forty (40) hours per week to successfully discharge the duties assigned. It is also understood <br />that the position will require occasional attendance at evening and /or weekend meetings. It is <br />understood by Ruecicert that additional compensation, overtime compensation, and <br />compensatory time shall not be allowed with reference to any such additional expenditures of <br />time. It is further understood that Ruecicert may absent herself from the office to a reasonable <br />extent in consideration of extraordinary time expenditures for evening and weekend meetings <br />at other than normal working hours subject to approval of the City Administrator. <br />4 <br />-5 <br />
