MINUTES <br />CITY COUNCIL <br />JANUARY 22, 2003 <br />VACATION OF <br />PORTION OF <br />SAVAGE LANE <br />AND PORTION <br />OF ROSE PLACE <br />Anderson noted the odd intersection of this cul -de -sac with Twin Lake <br />Road. Fahey suggested that the City Engineer comment on this as well. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Fahey, seconded by LaValle, the public hearing was <br />closed. <br />The City Administrator pointed out the Planning Commission's <br />recommendation that dry water main be required to be installed if this <br />development proceeds. The City Administrator noted the on -going <br />discussions with the City of Vadnais for bringing water main into this <br />area. He suggested that the property owner also be required to sign <br />Waivers of Right to Appeal water main assessments. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2003 -1 -21— TABLING ACTION ON THE <br />HA7VIEL COURT CONCEPT REVIEW UNTIL THE FEBRUARY 12, <br />2003 MEETING PENDING A REPORT FROM THE CITY <br />ENGINEER RELATIVE TO ACCESS FROM TWIN LAKE BLVD. AS <br />WELL AS INTERSECTION OF HAMEL COURT WITH TWIN LAKE <br />ROAD <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) Fahey, Blesener, Anderson, LaValle, Montour. <br />Nays (0). Resolution declared adopted. <br />Mayor Fahey opened the public hearing to consider the vacation of a <br />portion of Savage Lane as well as a portion of Rose Place as requested <br />by Mr. Sam Roberto. Fahey asked if the right -of -way for Rose Place <br />initially carne from the Roberto property. If it did, Fahey stated that he <br />was more inclined to vacate 10 feet of the right -of -way as it abuts the <br />Roberto property. If not, then he would be inclined to vacate 5 feet of <br />right -of -way on both sides of the street. <br />Blesener asked if the Rose Place pavement was centered in the right -of- <br />way. He also asked how far the Rose Place vacation would extend. The <br />City Administrator noted that the public hearing notice was written to <br />provide the Council with flexibility of vacating a portion of the Rose Place <br />right -of -way from Savage Lane to Morrison Avenue. The Council will <br />have to determine the appropriate distance. <br />6 <br />
