12 <br />substantially diminish surrounding property values. The proposed structure would <br />be fully located on the applicant’s property, would include ground-level windows <br />oriented toward the applicant’s yard, and would be used for private recreational <br />purposes by the household. <br />Staff also do not anticipate that construction or use of the proposed structure would <br />create any additional burden on public facilities or services. <br />While some neighboring residents may find the structure visually incompatible if <br />not adequately screened, staff believe those concerns are more appropriately <br />evaluated under the Conditional Use Permit criteria related to screening and to the <br />scale, orientation, and placement of the accessory structure. <br />4.The Conditional Use will not be detrimental to the health, safety, or welfare of <br />the public; <br />Staff have no evidence to indicate that construction or use of the proposed accessory <br />structure would be detrimental to public health, safety, or welfare. The structure <br />would be privately used, fully located on the applicant’s property, and subject to <br />applicable building and safety codes at the time of permitting. <br />Staff believe the primary issues for consideration by the Planning Commission and <br />City Council relate to visual compatibility and neighborhood character, rather than <br />health or safety impacts, which are addressed under other Conditional Use Permit <br />criteria. <br />5.The Conditional Use will not result in a nuisance by emissions; <br />Staff have no evidence to suggest that construction or use of the proposed accessory <br />building would result in a nuisance by emissions, including noise, vibration, glare, or <br />other impacts. The proposed use is limited to private indoor recreational activities <br />by the household. <br />The applicant currently has outdoor recreational amenities in the rear yard. <br />Enclosing recreational activities within a building is reasonably expected to reduce, <br />rather than increase, noise impacts to neighboring properties. <br />6.The Conditional Use will not unduly affect natural features.
