Agreement <br />Page 2 of 15 <br /> <br />Option #2 <br />Apply a premium “Silane” invisible, breathable, penetrating, weatherproofing sealer to all <br />masonry located on all exterior elevations. Silane has a 5-10+ year service life, will not change <br />the appearance of your masonry (limited to possible slight darkening) and acts by effectively <br />locking out water and the destructive salts and dirt water carries. This formula is specifically <br />designed for cold region applications and treated surfaces resist cracking, spalling, <br />mineral/efflorescence/biological/atmospheric staining and other damage related to water <br />intrusion/saturation. This product is VOC compliant and extends the attractive appearance and <br />service life of all treated masonry <br /> <br />We propose to furnish labor and materials complete in accordance with above specifications, for the sum of: <br />Main Bid - $43,700 including applicable taxes for credit card or PayPal payments add 4% <br />Payments to be made as follows: <br />Final invoice sent upon completion. All invoices/progress invoices will have Net 10 terms. 1.5% interest will <br />be added to all past due balances. <br /> <br /> ADD ON OPTION #1 – Extend maintenance to include selective tuckpointing, <br />spalled/cracked brick replacement, cracked block patching, installation of vertical control <br />joints and chemical cleaning – ADD $27,600 <br /> ADD ON OPTION #2 – Extend maintenance to include an application of a clear <br />penetrating sealer – ADD $19,100 <br /> <br />● Epic Masonry Restoration Inc. (EMR) shall furnish only the material and labor specified in this contract. <br />● This agreement contains the entire scope of work and is restricted to the main bid and any accepted optional work <br />described above. Any modifications or change orders must be made in writing. <br />● No determination involving structural integrity or need for repairs have been made by EMR. EMR does not provide <br />engineering services. <br />● This agreement does not include any work areas located below grade. All work areas located within a 10ft radius of <br />electrical service drops/electrical lines must be temporarily rerouted or have service suspended at owner’s expense to <br />safely access work areas. Owner is responsible for the suspension/rerouting of electrical service lines and any <br />damage/effects that may result. <br />● We reserve the right to withdraw this proposal if we do not receive a signed and accepted copy within (30) thirty days. <br />● Certificates for General, Automotive and Workers Compensation Liability insurance policies are available upon request <br />● EMR retains all ownership and proprietary rights of all submitted documents. This document contains confidential trade <br />information and shall in no part be disclosed by any method to any competitor of EMR. Use or duplication of this <br />document or information contained herein for any purpose other than the performance of this project by EMR is strictly <br />forbidden without prior written consent of EMR. <br />● Property Owner/Tenant/Buyer is to defend, indemnify and hold harmless EMR against any loss or claim by any tenants <br />due to construction operations. Property Owner/Tenant/Buyer bears any and all liability to its invitees/tenants relating <br />to this project including, but not limited to, damages, warnings, and protection. Masonry restoration often require <br />working conditions that involve noise, obstructions, the creation/disruption of silica dust, sparks and other hazards. All <br />reasonable measures will be taken to protect persons, property and plant life from the effects of any materials used or <br />techniques applied, however EMR shall not be held responsible for any damage that may occur. It shall be the Buyer’s <br />duty to protect the property and any invitees from any damage or disruption that may occur by taki ng reasonable <br />precautions including, but not limited to, notifying invitees/tenants, scheduling changes and keeping windows/doors/ <br />intake vents closed while work is in progress. Any obstructions of tree limbs prohibiting access to work areas may be <br />removed by EMR in order to fulfill this contract. <br />● Property Owner/Tenant/Buyer shall be responsible for providing access to electrical outlets, water connections and an <br />area to stage a trailer. Property Owner/Tenant/Buyer must maintain a minimum temperature of 40 degrees Fahrenheit in <br />all interior work areas during and for a minimum of 24 hours after all work hours. Property Owner/Tenant/Buyer shall <br />be responsible for property maintenance and protecting property from reoccurring damage and/or detrimental effects <br />including, but not limited to, those caused by water, moisture, steam, snow, ice, freezing, salt, impact, structural defects, <br />structural movement, biological growth, mineral accumulation, failed sealants or damaging conditions. EMR shall not be <br />held responsible for any damage that may occur. <br />● Contract price does not include erection/disassembly of heated enclosures or heating unless specified. <br />● EMR shall not be responsible for the transportation, storage, durability or performance of any existing building materials <br />owned or provided by the Property Owner/Tenant/Buyer.
