MINUTES <br />CITY COUNCIL <br />NOVEMBER 8, 2000 <br />MINUTES <br />CUP —K &J <br />CATERING - <br />433 LITTLE <br />CANADA RD. <br />Fahey asked if OSHA or ADA requires a separate women's bathroom at <br />the Public Works Garage or if a unisex bathroom was sufficient. Oertel <br />indicated that the unisex bathroom at the current garage is not adequate in <br />his estimation. Oertel pointed out that the 20% rule will require that the <br />City make reasonable accommodations at the Garage. <br />Fahey recommended that this issue be brought back to the Council when <br />the list of sites is compiled and the additional quote information is <br />obtained. Fahey thanked Oertel for his presentation. <br />Mr. Pedersen introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2000 -11 -263 — APPROVING THE MINUTES OF <br />THE OCTOBER 25, 2000 REGULAR COUNCIL MEETING AS <br />SUBMITTED <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, Scalze, Morelan, LaValle, Pedersen. <br />Nays (0). Resolution declared adopted. <br />Mayor Fahey opened the continuation of public hearing to consider an <br />application for Conditional Use Permit allowing a commercial recreation <br />use serving alcoholic beverages at 433 Little Canada Road as requested by <br />K & J Catering. It was noted that the Planning Commission has <br />recommended approval of the CUP. <br />Fahey noted that the City staff is recommending that a $900 annual fee be <br />charged K & J Catering under the Conditional Use Permit in order to <br />provide some equity with what on -sale liquor establishments are paying <br />for their licenses. <br />Tom Conroy, owner of 433 Little Canada Road, indicated that in the past <br />the rental hall had a Consumption & Display License that had an annual <br />fee of $300. Conroy reported on the economics of leasing his building, <br />and indicated that he has a music academy and K & J Catering that share <br />the same space. Without this shared arrangement, the rental situation does <br />not cash flow. Conroy felt that the $900 annual fee was too high, and felt <br />that for the first year while the rental hall is establishing itself, the fee <br />should be at the $300 level or less. <br />Morelan asked what the hours of operation are for the rental hall. Kurt <br />Adamson, K & J Catering, replied that the weddings, banquets, etc. he <br />caters usually go from 5 p.m. until Midnight. Adamson also pointed out <br />Page 6 <br />
