2948 Rice Street <br />McDonald Battery <br />This property was originally part of the Antler corporation, the developers of this business area. <br />In 1983 a request was made for zoning this area PUD. I believe that was to facilitate the <br />development and subdivision of the parcel and to provide access easement to the back properties. <br />In 1987 a business in the building, EAC, requested a variance from IP back to I -1, light industry. <br />That request was denied. According to the computerized realty information available on IRIS <br />McDonald bought the property 10 -1 -91. <br />The Fire <br />The State Fire Marshal's office is investigating this fire. As of today, 11 -9 -2001, we do not have <br />a report on their investigation. <br />Semi - Trailers <br />Per the city planner, Steve Grittman, the property has been zoned Planned Unit Development <br />(PUD) since 1996. Prior to 1996 it was zoned Industrial Park (IP). There is some indication in <br />the file, based upon a denied request from EAC for variance, that in 1987 the property was zoned <br />I -1, Light Industrial. In 1983 the developer requested a PUD to change the district from I -1. <br />The business EAC was in the building in 1987. They were not a trucking company and therefore <br />did not store semi trailers on the property. When McDonald bought the property it was zoned IP <br />and therefore they could claim some grandfathering for those uses which have been continuous <br />and are legal under IP but not authorized under the PUD. <br />Under the IP zoning, McDonald may park one semi trailer at each loading berth, and another for <br />each loading berth. McDonald has four (4) loading berths so they may have eight (8) trailers on <br />the property. However, all trailers must be parked on pavement, and four of the trailers must be <br />parked at the loading berth or be in transit to or from the loading berth. <br />I have sent a letter to McDonald Battery explaining this. The letter requests the removal of all <br />excess trailers and legal parking of any that remain. <br />I am trying to determine the licensing requirements for semi trailers. I know they do not have to <br />display a current year tab. I don't know whether or not they need a "fleet" tab. If a fleet tab is <br />needed we may be able to force removal under the nuisance ordinance for "unlicensed vehicles." <br />So far my calls to Sgt. LaBathe of the Sheriff's department, former traffic and commercial <br />vehicle officer, for an expert opinion have gone unretumed. <br />Tower <br />Per the Fire Marshal, Duane Williams, the tower was erected by the Antler Company. I can find <br />no record of any permit being issued for its construction. <br />Per members of the Little Canada Fire Department the tower was exposed to very intense heat <br />during the recent fire. <br />Page 39 <br />
