Contract No. 00I0031 <br />JOINT POWERS AGREEMENT BETWEEN <br />THE METROPOLITAN COUNCIL AND THE CITY OF LITTLE CANADA <br />FOR CONSTRUCTION OF A TRANSIT HUB <br />THIS AGREEMENT is entered into between the Metropolitan Council ( "the Council "), a <br />Minnesota political subdivision, and the City of Little Canada ( "the City"), a Minnesota <br />municipal corporation. <br />WHEREAS, the Council is authorized by Minnesota Statutes section 473.405 to construct, <br />equip, and operate transit and systems in the seven -county metropolitan area; and <br />WHEREAS, the City has agreed to make its property available, at no cost, for construction and <br />operation of the Interim Rice Street and Little Canada Transit Hub; and <br />WHEREAS, the City has engaged a contractor to perform other construction work, denoted as <br />Ramsey County Project Number 80570J, in the vicinity of the Interim Rice Street and Little <br />Canada Transit Hub; and <br />WHEREAS, the Council and the City desire jointly and cooperatively to provide for <br />construction of the Interim Rice Street and Little Canada Transit Hub through a change order to <br />the Ramsey County Project Number 805750J. <br />NOW, THEREFORE, in consideration of the mutual promises contained in this agreement, the <br />parties agree as follows: <br />I. DEFINITIONS <br />1.01 ADA. "ADA" is the acronym referring to the Americans with Disabilities Act, 42 <br />U.S.C. section 12101 et seq., containing requirements for new transit facilities. <br />Page 20 <br />
