The purpose of this agreement is to pass through to the City ownership of the street lighting as well as planters installed by the Council as part of the Project. In addition, this agreement provides for the City's Contractor to construct the Project for the Council through the City's issuance of a change order to Ramsey County Project Number 805750J (Little Canada Road Improvements). The City will pay its Contractor directly. This agreement also allocates the rights and responsibilities of the parties in relation to the Interim Rice Street and Little Canada Transit Hub Project. IH. CONSTRUCTION OF THE TRANSIT HUB 3.01 Design. The Council will prepare design plans and specifications for construction of the Interim Rice Street and Little Canada Transit Hub Project. The design must meet all applicable federal, state, and local requirements for transit facilities, including the ADA. Unless specified in the change order, all specifications will follow those of Project 8057503. Approval of these plans and specifications by the Council shall in no event be deemed to warrant the adequacy of the design or the quality of the materials used in the construction of any portion of the Project. 3.02 Contract Documents. The City will prepare a change order to its construction contract for construction of the Interim Rice Street and Little Canada Transit Hub Project according to the Council's design plans and specifications. The City will prepare the documents in compliance with all applicable federal, state, and local requirements. The City will submit a schedule for the staging of the work to the Council for review and approval, which approval shall not be unreasonably withheld. Upon Council review and approval of the change order and execution of the change order by appropriate representatives of the City and the Contractor, the City shall authorize the Contractor to construct the Project. 3.03 Construction. The City will administer the Third Party Contractors' contracts, inspect the work on the City's behalf, and complete the construction of the Interim Rice Street and Little Canada Transit Hub Project in accordance with the approved plans, bid specifications, Page 22
