III. COMPENSATION TO BUILDING OFFICIAL 1. Building Official shall be compensated for services based on the schedule as indicated on Exhibit "A ", a copy of which is annexed hereto and incorporated by reference herein. Exhibit "A" shall be in effect through the 3151. day of December, of the year 2000, and may be amended by mutual consent of the parties of this Agreement after that date. 2. Payment to Building Official by City for services rendered shall occur within 30 days after receipt of an invoice which documents the amount due. IV. GENERAL TERMS AND CONDITIONS The parties further agree as follows: 1. Building Official shall at all times during the term of this Agreement be certified as a Building Official of the State of Minnesota and provide evidence of same to City. Any subcontractors who assist Building Official in the performance of service to the City shall likewise be certified. 2. City shall not assume any liability for the direct payment of any salary, wage, workers compensation, income tax withholding, or any other type of compensation to Building Official for performing services pursuant to this Agreement. This remains the responsibility of the Building Official. 3. City shall assume responsibility for providing Building Official a current up -to -date copy of zoning and subdivision regulations, zoning and subdivision maps, comprehensive plan, and other regulations on development within City. 4. City shall be solely responsible for direct payment of any fees or charges to the Metropolitan Waste Control Commission, State of Minnesota or any of its subdivisions, and Ramsey County as may be required by law affecting development and issuance of building permits within its borders. 5. City, its officers, agents, and employees shall cooperate and assist Building Official in the orderly performance of services to be provided for herein. 6. All applications for building permits and building inspection forms to be utilized here under shall be provided by City. 7. City, its officers, agents, and employees do not assume any liability for neglect or intentional acts of Building Official or any of its officers, agents, or employees and Building Official shall indemnify and defend City, its officers, agents, and employees against and hold City, its officers, agents, and employees harmless from any claims, causes of action, damages, loss, cost, or expense resulting from or related to the actions of Building Official, its officers, agents, or employees in the performance of this Agreement.
