MINUTES <br />CITY COUNCIL <br />JULY 22, 1992 <br />DEVELOPER <br />DEPOSIT <br />COLLECTION <br />AUTO SALES <br />REPORT <br />The City Attorney presented to the Council two proposed <br />ordinances which address the collection of unpaid <br />developer deposit fees. <br />Mr. LaValle introduced the following ordinance and <br />moved its adoption: <br />ORDINANCE NO. 362 - AN ORDINANCE ADDING SECTION <br />921.009, ADMINISTRATION- APPLICANT'S COSTS, TO THE <br />MUNICIPAL CODE OF THE CITY OF LITTLE CANADA, RELATING <br />TO THE PAYMENT OF APPLICANT'S COSTS <br />The foregoing ordinance was duly seconded by Scalze. <br />Ayes (4) LaValle, Scalze, Hanson, Blesener. <br />Nays (0). Ordinance declared adopted. <br />Mr. LaValle introduced the following ordinance and <br />moved its adoption: <br />ORDINANCE NO. 363 - AN ORDINANCE AMENDING SECTION <br />1004.011 OF THE MUNICIPAL CODE OF THE CITY OF LITTLE <br />CANADA, RELATING TO THE COLLECTION OF DEVELOPER'S COSTS <br />The foregoing ordinance was duly seconded by Scalze. <br />Ayes (4) LaValle, Scalze, Hanson, Blesener. <br />Nays (0). Ordinance declared adopted. <br />The City Planner reviewed his report dated July 22 <br />regarding the auto sales issue. The Planner reported <br />that he has followed up on two particular operations <br />within the City. That is, Dave's Auto Sales on Condit <br />Street and Benchmark Auto in Ryan Industrial Park. <br />Dave's Auto is operating without an auto sales permit, <br />and the previous business license for auto repair <br />contained a number of conditions, one of which was a <br />limit on the number of vehicles that could be on the <br />premises at any given time. The Planner indicated that <br />the business has changed hands over the past several <br />years, and somewhere along the line the sales portion <br />of the business was added without benefit of a permit. <br />The Planner replied that from his research he cannot <br />find an application or approval for auto sales for <br />Benchmark Auto. The Planner indicated that he will <br />contact the business owner to obtain additional <br />information. <br />The Planner indicated that with regard to auto sales in <br />general, the City has several options available. One <br />option would be to do nothing, noting that the City has <br />records of seven applications for used auto sales prior <br />Page 17 <br />
