MINUTES CITY COUNCIL JANUARY 27, 1999 PUBLIC HEARING — ZONING ORDINANCE AMENDMENT RELATING TO SETBACKS Fahey indicated that he was O.K. with the gas station/convenience store at the corner, but did not feel a tire repair store was appropriate. Linn indicated that there are approximately 23 auto - related businesses within the City. These are mainly body shops and specialty -type shops. There are 6 or less auto repair shops in Little Canada, none of which are on Rice Street. Fahey indicated that the reason they are not on Rice Street is because of the zoning. If the City were to rezone this property for auto - repair, it would be faced with similar requests. Fahey indicated that it doesn't appear to be any interest on the part of the Planning Commission or the City Council in this concept. Morelan suggested that it may be an issue of timing. The City just updated the Comp Plan. If the request were made four or five years from now, and nothing had yet redeveloped on Rice Street, there may be some compelling reasons to proceed with the rezoning. Linn pointed out the Jiffy Lube site north of County Road C. It was pointed out that that property developed in the 1980's. If the proposal were made today, the Jiffy Lube would not be part of the development. Again, Morelan stated that if this proposal were made four or five years from now, the Council may be open to it. Morelan felt the proposal was a good one, but at this time is directly opposed to the vision the City has for the area. Mayor Fahey opened the public hearing to consider an amendment to Section 902.010 of the Little Canada Zoning Ordinance relating to the definition of setbacks. The Planning Commission recommended approval of the amendment. There was no one present from the general public wishing to comment on this matter. Upon motion by Morelan, seconded by Pedersen, the public hearing was closed. Mr. Morelan introduced the following ordinance and moved its adoption: Page 25
