Setbacks <br />Front yard <br />Side yards <br />Rear yard <br />40 feet from the property line <br />Not less than fifteen (15) feet on any one side, nor less than <br />forty (40) feet on the side yard abutting a street. <br />20 feet from rear boundary line <br />Open & Outdoor Exterior Storage (Accessory Use) <br />The applicant is requesting an exterior storage area for damaged and old vintage <br />automobiles, clips of cars and auto body parts as an accessory use on the side and rear <br />of the property as indicated on the site plan. <br />The municipal code (601.050) does not allow the piling, storing, parking, or keeping of <br />old machinery, wrecked, junked or abandoned vehicles, and other junk or debris on any <br />property in any zoning district in the city. The clips or cars and auto body parts must be <br />removed from the property. <br />The zoning ordinance allows for exterior storage of trucks and equipment to be stored in <br />the side or rear yards by conditional use permit and may encroach into the required side <br />and rear yard setback, and in no case shall equipment be located closer than 10 feet to <br />a rear yard or side yard lot line. (903.020.D.3) <br />Open and outdoor storage as a principal or accessory use is permitted with a <br />conditional use permit within the 1 -1 zone provided the following conditions are met: <br />1. The area is fenced and screened from view of neighboring residential uses or if <br />abutting an "R" District in compliance with Section 903.020.G. <br />2. The outdoor storage is fully screened from view from the public right -of -way in <br />compliance with Section 903.020.G. <br />3. The storage area must be paved with asphalt, concrete, or other material <br />approved by the City Council. <br />4. All lighting shall be hooded and so directed that the light source shall not be <br />visible from the public right -of -way or from neighboring residences and shall be in <br />compliance with Section 903.020.1. <br />5. The storage area shall not take up parking space as required for conformity in <br />the zoning ordinance. <br />Fence and Screening Requirements <br />The site plan shows an established chain link fence on the property. This fence would <br />have to be slatted on the east and north side to meet screening requirements. <br />The site plan also indicates that a trash enclosure will be established on the north side <br />of the property. This is permitted in this zoning district if it is fully screened from the <br />pubic right -of -way. <br />Page 109 <br />
