Setbacks <br />West Industrial Property <br />* See attached site plan dated July 9, 1999 <br />Front yard <br />Side yards <br />Rear yard <br />40 feet from the property line <br />Not less than fifteen (15) feet on any one side, nor less than <br />forty (40) feet on the side yard abutting a street. <br />20 feet from rear boundary line <br />Open & Outdoor Exterior Storage (Accessory Use) <br />The applicant is requesting two storage areas located on the eastem and western front <br />and side yards as shown on the site plan. The zoning ordinance allows for exterior <br />storage of trucks and equipment to be stored in the side or rear yards by conditional use <br />permit and may encroach into the required side and rear yard setback, but in no case <br />shall equipment be located closer than 10 feet to a rear yard or side yard lot line. <br />(903.020.D.3) Front yard storage is not permitted in any zoning district in the City of <br />Little Canada. In addition, semi -truck parking is a permitted accessory use in this <br />district, however, accessory uses may not encroach into the required front yard and only <br />in the side yard with a conditional use permit. <br />The applicant has applied for open and outdoor storage as an accessory use and as <br />such all materials and equipment must be associated with the three current property <br />occupants. Materials and equipment that are not acceptable for storage and may not <br />be stored in the designated areas as an items under this CUP are wood pallets, empty <br />drums, a motor home and a racecar trailer, because they are not associated with the <br />primary business and /or the materials have a potential to create a public nuisance. <br />Open and outdoor storage as an accessory use is permitted with a conditional use <br />permit within the 1 -1 zone provided the following conditions are met: <br />1. The area is fenced and screened from view of neighboring residential uses or if <br />abutting an "R" District in compliance with Section 903.020.G. <br />2. The outdoor storage is fully screened from view from the public right -of -way in <br />compliance with Section 903.020.G. <br />3 All fences and walls shall be constructed and maintained in accordance with the <br />requirements of Section 903.020.F.4. <br />4. Business and Industrial District security fences require a building permit and a <br />land survey establishing true boundary lines and must be completed by a <br />Registered Land Surveyor and submitted to the City's Building Official. <br />5. The storage area must be paved with asphalt, concrete, or other material <br />approved by the City Council. <br />Page 115 <br />
