RECOMMENDATION <br />Based on the information discussed in this report, staff recommends approval of the <br />proposed conditional use permit (CUP) application for an accessory use of exterior <br />storage of equipment and materials subject to the following recommendations: <br />1. The equipment and materials storage areas as defined in this report and indicated <br />by the applicant must be contained, maintained and arranged in a manner as to <br />have a well- organized and uncluttered appearance. <br />2. Junk, debris and other materials not approved, as part of this conditional use permit <br />shall not be stored in the designated storage areas. <br />3. The equipment and materials as indicated on the site plan must not be stored in the <br />required front yard (40 feet from the property line). <br />4. The equipment and materials must be stored in the side or rear yards and may <br />encroach into the required side and rear yard setback, but in no case shall <br />equipment be located closer than ten (10) feet to a rear yard or side yard lot line. <br />5. The outdoor storage area must be fully screened from the public right -of -way. The <br />screening location and materials must be indicated on the site plan. <br />6. Pending the variance a new site plan must be submitted to show the location of <br />approved materials and equipment designated as storage and the location and <br />materials of the required screening for the storage areas. <br />7. The applicant must apply and meet the fence (building) permit requirements as <br />established by the State Uniform Building Codes and the approval of the Building <br />Official. <br />8. The applicant must supply the Building Official with a land survey establishing true <br />boundary lines, which must be completed by a Registered Land Surveyor prior to <br />installation of the fence. <br />9. The storage area must be surfaced and maintained with asphalt, concrete, or other <br />material approved by the Council. The proposed Class V material is acceptable. <br />10.AII lighting shall be hooded and so directed that the light source shall not be visible <br />from the public right -of -way and must be in compliance with Section 903.020.1. <br />11.The required sixteen (16) parking spaces must be established and striped according <br />to the guidelines set in the zoning ordinance. <br />12. Storage area must not take up parking space as required for conformity to the <br />zoning ordinance. <br />13. All of the above mentioned conditions must be completed by December 31, 1999. <br />14. Property compliance with other zoning code issues mentioned in the following <br />section. <br />City staff recommends the denial of the variance for the use of exterior storage of <br />materials and equipment as mentioned in this report and indicated on the site plan from <br />the forty (40) foot required front yard setback to a twenty -eight (28) foot front yard <br />setback based on the following findings of fact. <br />1. The strict enforcement of the zoning ordinance does not preclude the applicant from <br />establishing an open and outdoor storage area on this property. The exterior <br />Page 117 <br />
