MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 9, 1999 <br />developing the Plan, the City looks at putting like uses together. <br />Montour suggested that perhaps at the time this property was <br />zoned I -1, the zoning worked. However, the surrounding area is <br />now residential. Montour noted that the Comp Plan is a vision of <br />what the City should look like in the future. The vision for this <br />area is residential. However, the City is not saying that these <br />businesses should move out. <br />Mrs. McCumber asked if there were any guarantees. Montour <br />replied that there were not. The Planner indicated that the City <br />would not force a business out. <br />Mrs. McCumber pointed out that if the property were rezoned to <br />residential there would be a substantial decrease in the value of the <br />land. <br />The Planner agreed that there are some value issues if the property <br />is converted to residential. However, the ordinance provides for <br />the continuation of the industrial uses as long as they exist. There <br />is also the provision that if the use is discontinued for six months, <br />than the use of the property would have to be in conformance with <br />the zoning. <br />Mrs. McCumber asked if a tenant left and the space was not lease <br />for six months, if that portion of the building could not longer be <br />used. The City Planner replied that the opinion of the City <br />Attorney will have to be obtained on the issue of one tenant. <br />However, if the entire site were not used for six months, than the <br />use definitely reverts to the zoning. <br />Mrs. McCumber felt the property could not be sold under the <br />conditions described. <br />Again, Mr. McCumber felt it did not make sense to rezone this <br />property which has been zoned I -1 for over 30 years. The property <br />is located on a freeway and in an area where other commercial <br />development exists. <br />Montour pointed out the large amount of residential development <br />surrounding this site. <br />Mr. Buetow, 3104 Edgerton Street, requested that his property <br />remain I -1 and indicated that he would be proposing to construct a <br />new building on the property so that he can get his storage inside. <br />Page 44 <br />
