Hanson <br />Attached is the proposed development agreement between Pratt Investment Company <br />and the City relative to the plat of Twin Lake Pines. The key aspects of this agreement are <br />as follows: <br />• Grading and utility work is being allowed prior to approval of the final plat. <br />Developer is acknowledging all risk associated with this factor and is <br />agreeing to make any changes required as a result of final plat approval <br />entirely at their cost. (Mr. Pratt has indicated his desire to install <br />improvements yet this fall with construction of the model home to occur <br />early in 2000.) <br />• This agreement is subject to the Joint Powers Agreement between the <br />City of Little Canada and the City of Vadnais Heights. As you know, this <br />agreement is not yet finalized. Developer is assuming all risk associated <br />with this factor as well. <br />• Developer's use of a private water supply to service units constructed <br />pending the availability of an adequate public source. (Mr. Pratt has <br />informed me that Vadnais Heights water study is consistent with the <br />findings of his engineer as to water supply to this subdivision. This has <br />not yet been confirmed by Vadnais Heights.) <br />Subject to any comments by the City Attorney, I would recommend approval of this <br />development agreement as presented. <br />Cc: Len Pratt <br />Gerry Urban <br />Page 39 <br />
