DEVELOPMENT CONTRACT <br />AGREEMENT, dated September , 1999, by and between the CITY OF <br />LITTLE CANADA, a Minnesota municipal corporation, ( "City ") and Pratt <br />Investment Company, a Minnesota Partnership ( "Developer "). <br />1. Request for Improvement. The Developer has requested the City to <br />allow the construction of sanitary sewer, storm sewer, with retention <br />ponding, water main, curb and gutter, bituminous streets, signage, and <br />lighting necessary to serve and provide access to the proposed plat of Twin <br />Lake Pines, within the City of Little Canada to serve the following <br />described property, as shown on Exhibit "A ": <br />Lots 1 -2, Block 1, Lots 1 -12, Block 2, and Outlot A, of Twin Lake <br />Pines, County of Ramsey, State of Minnesota. <br />2. Conditions of Approval. The City hereby approves construction of <br />necessary extensions of sanitary sewer, storm sewer, with retention <br />ponding, water main, curb and gutter, bituminous streets, signage, and <br />lighting to serve the Pitrina Park Terrace plat, conditioned upon the <br />Developer entering into this Agreement and guaranteeing compliance with <br />terms of this Agreement. City approval is further conditioned upon <br />Developer's acknowledgment that they are proceeding at their own risk with <br />all improvements to be undertaken given approval of final plat has not yet <br />occurred. Developer shall make any corrections necessary to the <br />improvements as required by final plat approval entirely at their cost and <br />subject to further review and approval by the City. <br />3.
