MJNYJ 1ES
PLANNING COMMISSION
NOVEMVLBER 18, 1999
RESIDENTIAL
MONUMENT
SIGNS
CLARIFICATION
RIFICATION
OF SETBACK
ENCROACH -
MENTS
TERMS OF
Cr FICE
ADJOURN
Kraemer recommended tabling action on the Conditional Use
Permit for 3101 Spruce Street until the December meeting pending
additional information on the utility issue.
Motion was seconded by Montour.
Motion carried 5 — 1. Duray voted against.
Keis indicated that at the request of City staff, the matter of
residential monument signs is tabled until the December meeting.
The Zoning Administrator reviewed the Zoning Ordinance with
regard to allowable encroachments into required setbacks. She
noted the references to terraces, steps, uncovered porches, stoops,
etc. pointing out that they refer to "above" ground level structures,
and areas that are paved at the defined ground level or as defined
in the Zoning Ordinance as "lowest level of the sky" are not
subject to this section of the Zoning Ordinance. Given the
confusion that this ordinance section has caused, the Zoning
Administrator recommended that it be amended to make it more
easily understandable.
The Commission agreed.
Montour recommended that a public hearing be called to consider
amending the Zoning Ordinance clarifying allowable setback
encroachments as recommended by City stall.
Motion seconded by Kraemer.
Motion carried 6 — 0.
The Deputy Clerk reported that the terms of office for John Keis
and Scott Barraciough expire December 31, 1999. Both Keis and
Barraciough indicated a desire to be reappointed for another three -
year term.
Montour recommended that the meeting be adjourned.
Motion seconded by Kraemer
Page 43
