Hanson <br />The development contract regarding Frank Frattalone's recycling operation at the corner of <br />Country Drive and Ryan Drive is once again up for discussion. Stockpiling and processing was <br />to have ceased on July 31, 1998. Storage activities are to cease by August 1, 1999. These dates <br />have triggered Mr. Frattalone's request for an extension of the previous agreement. (A copy of <br />his letter of request is attached.) <br />I have enclosed the pertinent information relative to past discussions on this subject as well as <br />the contract documents. Mr. Frattalone has complied with the terms of the development <br />agreement relative to the construction of a building, additional berming, and dust control. The <br />Council will need to deal with the policy issue of whether to allow this use to continue or not. <br />Should the Council wish to allow the use to continue, I would recommend the imposition of a <br />licensing fee. This fee could be used to offset the additional wear and tear on City streets <br />associated with this operation. Licensing could also be the manner by which we deal with <br />zoning consistency questions. (We authorize the issuance of one such license utilizing specific <br />zoning criteria similar to the way the Bingo Hall is handled.) <br />Staff would like the Council's direction as to how we should proceed with the consideration of <br />this matter. <br />JRH:kpp <br />Enclosures <br />cc: Frank Frattalone <br />Page 43 <br />
