MINUTES <br />CITY COUNCIL <br />MAY 11, 1999 <br />LaValle asked what the next step would be if these businesses do not bring <br />their properties into compliance. <br />The Administrator replied that the next step would be to issue citations. It <br />may take two to three months to process a citation with judges typically <br />ordering corrective action and imposing no fines. It may also take the <br />issuance of repeat citations to get the properties brought into compliance <br />with the Zoning Code. <br />Scalze felt that the issue was whether or not there were three council <br />members willing to enforce the code in the park. <br />Fahey stated that he was of the impression that the City had made some <br />progress in terms of code enforcement in the Park. However, he now <br />understands that to this point the efforts have not been significant. Fahey <br />felt that the Zoning Ordinance should be enforced and if the property <br />owners have to be cited, than that is what the City needs to do. Fahey <br />suggested that perhaps the staff should prioritize the offending properties <br />and start with the worst offenders. <br />The City Administrator pointed out that the City is trying to work through <br />the CUP process to bring properties into compliance and pointed out the <br />example of the Carle property on Country Drive which was before the <br />Council at its last meeting. The Administrator pointed out that as a result <br />of this CUP process the City will gain some site improvements and code <br />compliance it would not have otherwise gotten. The Administrator noted <br />that some of the issues for Council discussion are front yard exterior <br />storage, screening of side yard and rear yard exterior storage, storage of <br />junk cars. The Administrator suggested that there may be some <br />negotiation on the issue of front yard storage since there are some <br />properties in the Park without rear yards. Another issue is whether <br />exterior storage is related to the principal business use of the site. <br />Pedersen pointed out that there were some code enforcement efforts <br />occurring in the Park five to six years ago. <br />The Administrator agreed that there has been site specific /complaint -based <br />code enforcement in Ryan Industrial Park. However, there has not been a <br />comprehensive enforcement effort because of limited staffing and because <br />Ryan Industrial Park is a daunting enforcement effort. The City presently <br />has the staffing to address this situation, and would like direction from the <br />Council on some key ordinance provisions before processing CUP <br />applications for the Park as well as prior to the issuance of citations for <br />those properties not going through the CUP process. <br />PAGE 16 <br />
