DEVELOPMENT CONTRACT <br />AGREEMENT, dated September 9, 1998, by and between the CITY OF LITTLE <br />CANADA, a Minnesota municipal corporation, ( "City ") and Heritage <br />Development Minnesota, Inc., a Minnesota corporation ( "Developer "). <br />1. Request for Improvement. The Developer has requested the City to <br />allow the construction of curb and gutter, bituminous drives, signage, and <br />lighting necessary to serve and provide access to the proposed plat of <br />Heritage Office Park 3rd Addition, within the City of Little Canada to <br />serve the following described property, as shown on Exhibit "A ": <br />Lots 1 -6, Block 1, Heritage Office Park 3rd Addition, County of <br />Ramsey, State of Minnesota. <br />2. Conditions of Approval. The City hereby approves construction of <br />necessary extensions of curb and gutter, bituminous drives, signage, and <br />lighting to serve the Heritage Office Park 3rd Addition plat, conditioned <br />upon the Developer entering into this Agreement and guaranteeing compliance <br />with terms of this Agreement. <br />3. Compliance with Laws and Regulations. The Developer represents <br />to the City that to the best of its knowledge the construction of <br />improvements to serve the Heritage Office Park 3rd Addition subdivision <br />will comply with all City, County, Metropolitan, State and Federal laws and <br />regulations, including, but not limited to, subdivision ordinances, zoning <br />ordinances, noise ordinances, and environmental regulations; including <br />wetland impact and mitigation. The Developer shall obtain all necessary <br />permits and consents for the project including, but not limited to, the <br />permit required by the Minnesota Department of Health due to the water main <br />extension, any necessary permits required from the Minnesota Pollution <br />Control Agency for sanitary sewer main extension, any necessary approvals <br />Page 22 <br />
