MINUTES <br />CITY COUNCIL <br />SEPTEMBER 26, 2012 <br />the problems the City has had with these uses. He stated that amending <br />the Zoning Code was a difficult consideration for him. <br />Dan King indicated that the location would be ideal for an auto sales lot. <br />He stated that he would create a business that the City would be proud of <br />King noted that when a car is purchased at the dealers' auction, there is <br />always something that needs to be fixed. Therefore, in addition to auto <br />sales, auto repair and auto detailing would be done on site. King indicated <br />that there would be no outdoor storage of repairable vehicles on the site. <br />Meyer stated that everything being requested could be done within the <br />building. Permanent outdoor storage would be screened with fencing. <br />King suggested that the Zoning Code be amended to allow the uses and if <br />there are any problems, the licenses could be revoked. Keis explained the <br />City's history with issuing citations and taking property owners to court <br />noting how ineffective this process has proved to be in the past. <br />Meyer stated that he would stand on his own record. Keis pointed out that <br />this is not about Mr. Meyer, but about what is good for the City in the <br />long -term. McGraw supported Keis' comments, and again stated that this <br />is not about Mr. Meyer, but about the City's past experience. <br />Keis stated that the 1 -P District is not the place for auto repair and auto <br />sales uses. <br />Adam Meyer stated that he appreciated the Council's comments and <br />understand where the individual Council Members are coming from. He <br />pointed out that his client is not asking for anything this evening. <br />Meyer asked if he could use his building to park his own vehicles as well <br />as medical equipment. The City Administrator reported that the storage of <br />personal vehicles and equipment within the building is not an allowed <br />principal use in the 1 -P District. While this would be a Code violation, the <br />Administrator stated that the City has not issued a notice of the violation. <br />Montour suggested that Meyer discuss the issue with City staff. The <br />Administrator pointed out that he cannot permit Mr. Meyer to store his <br />personal vehicles and equipment, and indicated that the City has pursued <br />no enforcement action against this violation to date. <br />McGraw suggested that Mr. Meyer and his attorney consider this <br />discussion this evening; and if they so desire, make a formal proposal to <br />the Council. <br />14 <br />
