MINUTES <br />CITY COUNCIL <br />SEPTEMBER 26, 2012 <br />DECLARE <br />MORATORIUM <br />ON AUTO - <br />RELATED USES <br />AMEND THE <br />ZONING <br />CODE — <br />INDOOR <br />RETAIL <br />AUTO SALES <br />The City Administrator noted that a Public Hearing has been scheduled for <br />this evening to consider an Amendment to the Zoning Code relative to the <br />Indoor Retail Sales Zoning and Administrative Permit Sections of the <br />Code. The Administrator suggested that in light of the proposal by City <br />staff to declare a moratorium on auto- related uses in applicable zoning <br />districts, he would recommend that this Public Hearing be tabled until the <br />auto - related use study is completed and the moratorium lifted. The City <br />Planner agreed. <br />The City Planner reviewed his proposed moratorium ordinance which <br />would establish a 12 month moratorium on the application for and /or <br />issuance of licenses or zoning approvals and /or the operation of new <br />business premises for any auto- related use. Enactment of this moratorium <br />will give the Council an opportunity to study the numerous issues the City <br />is facing relative to auto - related uses. If that study cannot be completed <br />within a 12 month period, the Council can hold a public hearing to <br />consider extending the moratorium. If the study can be completed sooner, <br />then the Council can lift the moratorium prior to its expiration. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -9 -168 — ADOPTING AN ORDINANCE <br />ESTABLISHING A TWELVE MONTH MORATORIUM WITHIN <br />THE CITY OF LITTLE CANADA PROHIBITING THE <br />APPLICATION FOR AND /OR THE ISSUANCE OF LICENSES OR <br />ZONING APPROVALS, AND /OR THE OPERATION OF NEW <br />BUSINESS PREMISES FOR THE FOLLOWING USES: <br />AUTOMOBILE REPAIR, MINOR; AUTOMOBILE REPAIR, MAJOR; <br />AUTOMOBILE REPAIR, SALVAGE; NEW OR USED AUTOMOBILE <br />SALES, INDOOR; NEW OR USED AUTOMOBILE SALES, <br />OUTDOOR SALES LOTS; JUNKING OR SALVAGE OF <br />AUTOMOBILES, AND /OR THE SALES OF USED PARTS FROM <br />USED OR SALVAGE VEHICLES <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />Given the moratorium ordinance just adopted, it was the consensus of <br />the Council to continue the public hearing and table action on the <br />proposed Amendment to the Zoning Code relative to Indoor Auto Retail <br />Sales Zoning and Administrative Permit Sections of the Code. <br />Montour introduced the following resolution and moved its adoption: <br />15 <br />
