DRIVING DIVERSION PROGRAM <br />Introduction <br />The Driving Diversion Program (DDP) seeks to assist individuals who have been charged <br />with driving after suspension/revocation (DAS or DAR) to earn back their valid license status <br />through a supervised payment plan, a mandatory financial management and life skills course, <br />and the issuance of a temporary diversion license. <br />FCS and each participant create a monthly payment plan to pay off ALL existing unpaid <br />fines and reinstatement fees that are affecting his /her driver's license status. Participants are <br />given a valid DDP driver's license allowing them to legally drive while they are successfully <br />enrolled in the DDP Failure to abide by the program's conditions, including monthly payment <br />plan payments, valid insurance, and good driving conduct, will result in an immediate loss of the <br />DDP license and the person will revert back to their original suspension or revocation status and <br />potential prosecution on the original charge(s). <br />Participation <br />The DDP was not created to be a "clean slate" program. Many drivers simply will not <br />qualify for the program'. The DDP focuses on drivers with a suspended or a revoked driver's <br />license. A driver who is charged with DAS or DAR may be eligible to participate IF: <br />1. The offense occurred in one of the five participating pilot cities; <br />2. The case is still "pending" (i.e. the driver has NOT yet paid the fine amount for that <br />citation and /or the offender has NOT yet pled guilty to that offense); and <br />3. The offender has a Class D driver's license. <br />Ultimately, however, the prosecutor retains the discretion of whether an offender is admitted to <br />the program. <br />Drivers with the following driving status will 2 NOT qualify for the program: <br />t. A driver with a Commercial Driver's License (CDT.); <br />2. A driver who was driving a conunercial vehicle at the time of' the offense; <br />3. A driver who is currently canceled OR is canceled as inimical to public safety UPS); <br />4, A driver who is currently suspended for failure to pay child support payments; <br />5. A driver who is currently revoked or has been revoked for: criminal vehicle operation (CVO), a <br />controlled substance crime, fleeing police in a motor vehicle, or theft of motor vehicle; or <br />6. A driver who is suspended because a civil ,judgment has been docketed against his /her driver's <br />license. <br />2 <br />
