MINUTES <br />PLANNING COMMISSION <br />APRIL 9, 1998 <br />Pam Bennett, 795 Viking Drive, reported that in 1995 the City agreed that <br />the development of the Kimmes property would be limited to three lots. <br />Bennett reported that three property identification numbers were assigned <br />to this property. Bennett stated that as part of the road improvement <br />project, the neighbors agreed they wanted to maintain the same traffic <br />flow through the neighborhood, and less than standard road widths were <br />improved. At that time the City agreed that no more than three lots would <br />be allowed to develop on this property. Bennett asked how this action can <br />now be superceded by Mr. Kimmes. Bennett expressed a great deal of <br />frustration with the fact that five lots are now being considered when she <br />indicated that the City and the City Administrator assured the property <br />owners that a maximum of three would be allowed. <br />Bennett reported that the property owners are not opposed to Mr. Kimmes <br />developing his property, but they do expect the City to stand by the three <br />lot maximum that was agreed to a few years ago. Bennett questioned why <br />previous meeting notes were not researched to find the assurances which <br />were made. Bennett questioned the City's changing the character of the <br />neighborhood after it assessed property owners $12,000 to $15,000 each <br />for the water main and road improvements which were made in 1995. <br />Bennett indicated that a five -lot development was never the understanding <br />of the neighborhood. Bennett suggested that if the neighbors had known <br />this, they would have obtained legal representation back when the road <br />improvements were being discussed. Bennett asked that the City stick to <br />its original agreement. <br />Barraclough reported that the Planning Commission does have copies of <br />the meeting notes referred to by Bennett, and those notes do not reflect <br />that the City made any assurances as to the number of lots that could be <br />developed from this property. <br />Bennett stated that apparently the property owners did not get these <br />assurances in writing. <br />Barraclough reported that there was a lot of discussion about the road <br />improvement and the area at the neighborhood meeting held on November <br />22, 1994, but there were no promises made that there would be three lots. <br />Bennett indicated that the property owners were adamant they did not <br />want the neighborhood changed. Bennett stated that she cannot believe <br />this is now happening. <br />Page 27 <br />
