MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 12, 1998 <br />downstream and questioned the effect of this development on those <br />problems. <br />The City Engineer suggested that downstream problems should be <br />addressed regardless of what happens with the Gilanderi Addition plat. <br />Ducharme indicated that he is trying to keep an open mind, but was <br />concerned about dealing with five new neighbors should there be drainage <br />problems for him. <br />Keis pointed out that the plat as proposed depends on whether or not <br />Ducharme is willing to grant the ponding easement. <br />Ducharme stated that he was not thrilled about having the easement on his <br />property, and again was concerned about future problems. <br />Keis pointed out that if Ducharme does not grant the easement, the plat as <br />proposed does not meet City requirements and must be denied. <br />Paul Anderson, 775 E. Viking Drive, indicated that David Smith, the <br />former owner of the Kimmes property, led the neighborhood to believe <br />that the property would be developed with three lots. Anderson stated that <br />the neighborhood had no problem with a development that consisted of <br />three lots. Anderson felt this would eliminate the need to pond onto the <br />Ducharme property. <br />Keis pointed out that from a planning standpoint if a plat consisting of five <br />lots meets all of the City's requirements, there is no reason to deny the <br />plat. <br />Anderson indicated that the neighborhood was divided into one -acre <br />tracks, and a five -lot development deviated from that standard. It was <br />pointed out that a property owner with a one -acre lot would have the <br />ability to subdivide their property. <br />DeLonais indicated that the reason the preliminary plat was tabled by the <br />Planning Commission was to address drainage issues. <br />David Farley, 777 E. Viking Drive, felt the issues were not only drainage, <br />but location of lot lines and property values. <br />Keis pointed out that the issue this evening is whether or not Mr. <br />Ducharme is willing to grant an easement for ponding. If not, then the plat <br />does not meet City standards. Ducharme stated that he was not ready this <br />evening to make a decision on the easement. <br />3 <br />Page 17 <br />
