MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 12, 1998 <br />Chuck Plow stated that the developer approached the drainage with the <br />desire to make it better for both his property and the Ducharme property. <br />Kimmes indicated that it is difficult to develop Lot 1 without doing <br />something on the Ducharme property and taking care of the hole that <br />exists on Lot 1. <br />Montour pointed out that there are a lot of open issues that need to be <br />addressed. However, until the easement issue can be resolved, Montour <br />recommended that action on the plat be tabled. Montour suggested that <br />Mr. Kimmes and his engineer meet with Mr. Ducharme and the other <br />interested property owners in the area to try to work out an acceptable <br />proposal. Knudsen indicated that the easement issue is the first one that <br />needs to be resolved. <br />Ducharme stated that at this point he was uncomfortable with the <br />easement, and would rather see the ponding contained to the Kimmes <br />property. <br />The Planner pointed out that what the Planning Commission has before it <br />is a plat that is proposed on land that is not under the control of the <br />developer. The other issues are mute until the easement issue is resolved. <br />The Planner recommended that either Kimmes negotiate an easement with <br />Ducharme or come back with a plat that includes property solely under his <br />control. <br />Ducharme stated that he would like to let Kimmes plat the property as he <br />is proposing, but would like to know the effect on his property should he <br />decide to plat a couple of lots on his property. The City Planner pointed <br />out that any land dedicated to ponding would be eliminated from what <br />Ducharme could plat. Keis suggested that these issues be discussed with <br />Mr. Kimmes' engineer. <br />Ducharme pointed out that there is an NSP easement through the area and <br />wondered how this would effect the plat. <br />The City Planner recommended that either Mr. Kimmes request that action <br />on the preliminary plat be tabled at this time subject to resolution of the <br />property issue. Without such a request, the Planning Commission should <br />deny the plat as presented given the time constraints within which the <br />Planning Commission to act on a submittal. <br />Dick Kimmes requested that the Planning Commission table action on the <br />preliminary plat for the Gilanderi Addition in order to allow him time to <br />negotiate an easement with Mr. Ducharme. <br />4 <br />Page 18 <br />
