MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 2012 <br />to hookah establishments informing them of issues relative to hookah <br />establishments in light of the Clean Indoor Air Act. <br />Keis pointed out the Council's effort to work with The Hookah Hideout <br />and grandfather in their license. Keis noted that as part of the Tobacco <br />Ordinance amendment The Hookah Hideout is not allowed to sell the <br />business and pass on their license. The license terminates when the <br />current owner of The Hookah Hideout ceases business or does not renew <br />his license. Keis agreed with the Mayor that he would not be interested in <br />amending the City's ordinance until the Legislature addresses the Clean <br />Indoor Air Act. McGraw stated that prior to making any changes to the <br />City's ordinance, he would want to know what the State is going to do <br />relative to the Clean Indoor Air Act. <br />Ellery stated that in the event the State makes some changes, he would like <br />to come back to Little Canada to see if the City would work with them. <br />The Council thanked Ellery for coming to the meeting. <br />CALL FOR The City Administrator reported that MN DOT is moving forward with <br />PUBLIC the addition of a MN PASS lane from Little Canada Road to Maryland <br />HEARING Avenue. The project will begin in 2013 with completion in 2015. MN <br />ON MN DOT is seeking municipal consent for this project from all the <br />PASS LANE municipalities impacted by the project. In considering the project, the <br />City has the option to grant consent, grant conditional consent, or do <br />nothing. No action on the part of the City will be considered approval. In <br />granting conditional consent, MN DOT can review the City's requested <br />conditions and can appeal and override the conditions, although <br />historically they have not. <br />The Administrator reported that MN DOT is requesting that the City hold <br />a public hearing on the MN PASS project, and staff is recommending the <br />hearing be held on Wednesday, November 28th at 7:30 p.m. The <br />Administrator pointed out that last evening MN DOT held an open house <br />on the project at City Hall. The issue of sound walls was discussed with <br />residents, and there are some areas abutting the project where property <br />owners favor additional sound walls and some not. The Administrator <br />noted that the Heather Oaks property owners abutting the project do not <br />support the addition of a sound wall, but would like to have additional <br />landscaping installed. <br />The Administrator also reported that as part of the MN PASS project <br />Country Drive will have to be excavated to repair a storm sewer pipe. <br />This pipe is very deep, and the work could result in Country Drive being <br />closed for up to two weeks. <br />5 <br />
