MINUTES <br />CITY COUNCIL <br />JUNE 101, 2026 <br />has increased the direct cost for the project; it is appropriate to pursue the bid bond claim. <br />Schwalbach recognized that the bids were already slightly over the estimated project cost, so <br />this continues to increase the project cost. <br />The City Engineer stated that the sidewalk segment would be constructed with a future street <br />project, if it were not done as part of this project and explained that the City was able to <br />capitalize on grant funds to reduce the project cost and complete the project earlier. <br />Schwalbach stated that if this scenario hardly ever happens, and this action will not tarnish the <br />reputation of the city, he would support moving forward with the bid bond claim. He stated that if <br />submission of the bid bond claim would tarnish the reputation of the city and discourage <br />contractors from wanting to work with the city, he would not want to pursue that. <br />Mayor Fischer echoed those comments and believed that it is worth pursuing, and then they can <br />determine if it is worth filing. <br />Malone asked and received confirmation that the funding from both Ramsey County and Little <br />Canada would increase if the bid bond claim is not successful. <br />Kwapick stated that it was his understanding that the bid bond is binding and the City would <br />receive those funds. <br />The City Engineer replied that the amount listed in the staff report is five percent of the bid, <br />which is the maximum the City could request. He stated that he has never done this, nor has the <br />City Attorney, but it should be successful. <br />Kwapick stated that the project is extremely important for this corridor, as there are extreme <br />mobility issues that exist. He recognized that it would be more money for the city, but it is still a <br />value to complete this now compared to waiting another three years at a higher cost. Mayor <br />Fischer agreed that he would not want to wait on this segment and wants to move forward. <br />Schwalbach introduced the following resolution and moved its adoption: <br />RESOLUTION NO.2026-6-86 — RESCINDING THE CONTRACT A WARD TO CLARK <br />COMPANIES <br />The foregoing resolution was duly seconded by Kwapick. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />Schwalbach introduced the following resolution and moved its adoption: <br />RESOLUTION NO.2026-6-87 — AWARDING THE CONSTRUCTION CONTRACT TO <br />THOMAS AND SONS CONSTRUCTION IN THE AMOUNT OF $599,484.20 <br />The foregoing resolution was duly seconded by Malone. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />7 <br />
