7. The applicant had 120 days to clean up existing junk and storage on the <br />property. <br />The subject site is zoned PUD, Planned Unit Development and is guided for commercial <br />land uses. The site is .96 acres in size, with just 70 feet of frontage along Rice Street. <br />The purpose of the PUD, Planned Unit Development District is to provide for the <br />integration and coordination of land parcels as well as the combination of varying types <br />of residential, commercial and industrial uses. <br />The subject site currently contains a single family home, a detached garage, and a <br />second detached garage utilized as a warehouse. The applicant has indicated the <br />property is currently for sale, and has requested the interim PUD permit to operate the <br />site as existing until it is sold. The site is guided for commercial land uses, and the City <br />would like to see the site redeveloped in a manner consistent with the Comprehensive <br />Plan. <br />The single family home on the site is currently vacant, but had formerly been a rental <br />property. The applicant also rents the warehouse/garage to a tenant who uses the <br />space to repair cars and other vehicles. The applicant has stated that this operation is <br />not a business, but a hobby use. The current tenant would like to continue using the <br />warehouse. The property owner would make the house available to the tenant for the <br />use of the restroom and access to running water. Under a typical building code <br />arrangement, restroom facilities would be required in the warehouse building. <br />Both the rental residential use and the "hobby" auto repair use were established without <br />proper zoning approvals. The City has been working on enforcement efforts to remove <br />the illegal uses from the property. The applicant is requesting an extension of the PUD <br />interim use permit based on her current compliance with the terms of the original <br />approval. <br />Conclusion <br />The applicant is proposing to continue the existing auto repair hobby use on the <br />property until it is sold. According to the applicant, the renter, as well as two to three <br />other associates, is on the site repairing vehicles Monday through Friday, throughout <br />the entire workday. Minor auto repair, as a business, is not a permitted use in the PUD <br />District. <br />The applicant indicates that outdoor storage has been eliminated on the site, and <br />suggests that the site is in compliance with the requirements imposed by the original <br />City Council approval last year. <br />2 <br />is <br />
