Alternative Actions <br />Regarding the request for an interim PUD permit, the City has the following options: <br />Motion to approve the PUD Permit, based on a finding that the proposed use <br />may be temporarily supported by the site. <br />2. Motion to deny the PUD Permit, based on a finding that the proposed use not <br />consistent with the intent of the PUD District. <br />Recommendation <br />The hobby use is technically inconsistent with the commercial designation of the <br />property. The applicant has acknowledged these issues, and is proposing that the use <br />be allowed for a temporary period pending sale of the property. <br />While a permit for an interim use can be a convenient zoning tool, it can also sometimes <br />be difficult to terminate a use once the permit expires. However, such permits can also <br />allow for the phase-out of an activity over time, inducing a property owner to seek a new <br />use. Due to the lack of public complaints over the use of the property, it may be <br />reasonable to grant the PUD permit for interim use with clear conditions about <br />termination and re-use of the property. <br />If the City determines that the proposed interim PUD permit is appropriate, staff <br />recommends that approval be subject to continuation of the conditions of the original <br />permit.
