MINUTES <br />CITY COUNCIL <br />APRIL 9, 2008 <br />ABATEMENT <br />PROCESS - <br />RUTH AND <br />JACKSON <br />STREET <br />PROPERTIES <br />THE PURPOSE OF HEARING THE ABDO MARKETPLACE <br />DEVELOPMENT PROPOSAL <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />The City Administrator noted the Code Enforcement Officer's report <br />on code violations at 2532-2538 Ruth Sheet and 2620-2622 Jackson <br />Street. Since the report was issued, the property at 2620-2622 Jackson <br />Street has been cleaned up. Therefore, at this time the Code Enforcement <br />Officer is requesting authorization to proceed with abatement of the <br />nuisance at 2632-2638 Ruth Street (garbage dumped along the driveway). <br />The Council also discussed the fact that the owner of the Ruth Street <br />property does not have garbage service for his tenants. The Code <br />Enforcement Officer will be addressing this situation, and may come in <br />with a recommendation to the Council at its next meeting. <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2008-4-707 -FINDING THE EXISTENCE OFA <br />PUBLIC NUISANCEAT 2532-2538 RUTHAND ORDERTING THE <br />ABATEMENT OF SAME <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />ABATEMENT The City Administrator reviewed his report dated April 4, 2008 relative <br />AGREEMENT - to the Abatement Agreement between the City and Katherine Hamalainen, <br />122 DEMONT 122 Demont Avenue, Unit #274. The Administrator noted that the City <br />AVENUE, ordered the abatement of the code violations for this property at its <br />UNIT 274 February 27`x' meeting. Given some due process concerns, the <br />Administrator recommended granting the property owner some additional <br />time to complete the corrective work. He noted that the Abatement <br />Agreement contains specific time lines by which the work must be done. <br />Should those timelines be missed, the City would then proceed with the <br />abatement. The Administrator indicated that the City Attorney has <br />reviewed the agreement and finds it to be in order. The Administrator also <br />noted that until the corrective work is completed, the City is prohibiting <br />occupancy of the property and the electricity to the unit has been turned <br />off. <br />10 <br />
