MINUTES <br />CITY COUNCIL <br />APRIL 9, 2008 <br />The Adminisri•ator pointed out that the current franchise fee expires in <br />December of 2008, and the City must give Xcel Energy notice of the <br />extension of the fee at least six months prior. Xcel Energy has reviewed <br />the City's ordinance as well as the franchise documents, and agrees it is <br />within the City's ability to extend the franchise fee provided that the rate <br />remains the same. If the rate were to change, the City would have to enter <br />into negotiations with Xcei. <br />The City Administrator reported that a number of other cities have the <br />franchise fee in place. He also noted that many cities have storm water <br />utilities or fees for service, which Little Canada does not. <br />Mr. McGraw inhoduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2008-4-98 -AMENDINGAPPENDIX C OF THE <br />MUNICIPAL CODE RELATIVE TO SUNSET OF ELECTRICAL <br />FRANCHISE FEE <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />CONDIT The City Administrator reviewed his report dated March 31, 2008 <br />STREET recommending that the Council call for an improvement hearing to again <br />consider the reconstruction of Condit Street. The Administrator reported <br />that the condition of Condit Street is extremely poor and is deteriorating <br />rapidly. He presented pictures showing the street's present condition. <br />The Administrator noted that a hearing was recently held to consider the <br />urban reconsriuction of Condit Street. The adjacent property owners were <br />opposed to the full urban reconstruction given impacts on existing trees as <br />well as objection to the proposed street width. <br />The Administrator stated that given the existing condition of the street, it <br />is questionable how long the City will be able to keep the road passable. <br />He also noted that given the economic climate, it may be possible to <br />obtain a very favorable bid on the work. Based on this, the Administrator <br />recommended that the Council consider the option of a rural section <br />roadway at the same width and pavement location as currently exists. It <br />should be noted, however, that the City's assessment policy provides for a <br />100% assessment of rural section improvements. Therefore, the cost to <br />assessable cost to property owners would be only slightly less than full <br />reconstruction. <br />
